CAT notice to Guj Govt on senior police officer's plea

1988-batch IPS officer Yadav alleges was harassment in a case related to former home minister, late Haren Pandya

The Central Administrative Tribunal (CAT) has issued notice to Gujarat government on a petition filed by an IPS officer challenging three charge sheets served to him.

A bench of CAT yesterday also issued notice to the central government on the petition filed by 1988-batch IPS officer R S Yadav and kept further hearing on March 12, 2013.

Yadav, who was in 1997 and 1999 posted in Gandhinagar as District Superintendent of Police, has sought the quashing of three charge sheets filed against him by the state government between 2002 and 2004, when he was under suspension.

He claimed in his petition that the government was "harassing" him over the issue of his request for granting permission to prosecute former Home Minister, late Haren Pandya, in connection with the case of kidnapping of a nine-year-old girl Ruchi in 1999.

"During the investigation of the case he arrested some individual that earned him displeasure from the political bosses, including the then Minister of State for Home Haren Pandya and enmity of some unscrupulous police officers," he claimed in his petition.

"The Home Minister directly interfered with the investigation. Therefore permission was sought from the government to prosecute Pandya. As a result, Pandya started harassment," said the petition.

Later, Yadav was transferred to Junagadh and subsequently suspended from service in February 2000 for 'mishandling' the kidnapping case.

In 2001, another departmental inquiry was proceeded against him for not staying at the headquarters during the suspension period, which was followed by yet another probe in 2003 for not depositing the service revolver in time.

He was served three different charge sheets by the state government pertaining to three inquiries.

Yadav was later dismissed from service in 2006 but got reinstated in 2010 by the order of CAT, New Delhi, which had held that the inquiries by the state government were ex-parte and hence not in accordance with rules.

Yadav has been serving as State Reserve Police Force (SRPF) Commandant at Jamnagar since his reinstatement.
