2G case: HC asks Tihar officials to examine I Pad of accused

Tihar jail officials to get I Pad checked by the IT department of Delhi government as to whether it can be misused for communication or not

The Delhi High Court on Wednesday asked Tihar jail authorities and the city government to examine an I Pad, to be used by an accused for reading digitalised case files in the prison, to ascertain if the equipment can be misused for communication.

"The I Pad be submitted at 11 am tomorrow to the Tihar jail officials who will get it checked by the IT department of Delhi government as to whether it can be misused for communication or not," Justice S Muralidhar said.

"You will have to find a way out. The chargesheet is running into 80,000 pages and moreover, the trial is going on on day-to-day basis," the court said.

The court's response came when Delhi government expressed its inability saying Asif Balwa, Director of Kusegaon Fruits and Vegetables, cannot be allowed to use I Pad as it is not permitted by the jail manual.

"Times have changed. At any stage, you can withdraw the facility if you find that I Pad is tampered with and is being used for sending e-mails or communication," it said

To this, the government counsel said security personnel are not equipped to detect any tampering with the gadget.

"Moreover, one of the accused was recently caught with a Blackberry mobile phone inside Tihar and not only that they keep on interacting with their relatives during the hearing at trial court," she said.

The court, meanwhile, allowed home-cooked vegetarian food to the accused twice a week.

Vijay Agarwal, counsel for Asif Balwa, said except Tihar, most of the jails in the capital are "air-cooled".

The court has fixed the matter for hearing on May 27 on the plea of Asif Balwa seeking permission to carry an I Pad having digital version of the CBI chargesheet.

The corporate executive, arrested for his alleged role in facilitating the transfer of a sum of Rs 200 crore to DMK's party-owned television channel Kalaignar TV through his firm in a circuitous manner, also sought the court's permission to have home-made food inside the jail.
