HC ensures arrangement between Matrix, Vodafone

Matrix Cellular approached High Court alleging Vodafone terminated the agreement between the two firms by serving a notice

The Delhi High Court has asked Vodafone Essar to restore services of Matrix Cellular Services, which offers telecom solutions to Indians visiting abroad, for next two months on providing help to post-paid subscribers.

Justice S Muralidhar, disposing of the petition of Matrix, gave an interim order ensuring an agreement between it (Matrix) and Vodafone.

"Vodafone will forthwith restore services to Mobile No 9811188888, which is in the name of Matrix, and make the same operational as it was on October 13, 2011, i.e, prior to the issuance of the letter on October 14, 2011," the court said.

Matrix Cellular approached the High Court alleging that Vodafone on October 14 terminated the agreement, entered between the two firms on July 10, 2003, by serving a notice.

which had said "the agreement would stand terminated two months thereafter".

As per the agreement, Matrix was empowered to provide services to 65,000 consolidated post paid subscribers of Vodafone, it said.

Matrix, in its plea, said "soon after the receipt of the said letter (termination notice) dated October 14, 2011, Matrix found that service calls being made to mobile number 9811188888, belonging to Matrix, by the consolidated post paid subscribers were getting diverted to and being answered by Vodafone."

Justice Muralidhar, in his October 20 order, said "The number of hunting lines in relation to the above mobile number 9811188888 would be limited to 20."

The court said the mutually agreed arrangement would remain in force for next two months and the termination notice would be operative after that.

The court also said the representatives of Vodafone can remain present in the office of Matrix to monitor the calls on 9811188888.

Matrix also gave an undertaking that it would abide by "the law and the terms of the agreement" including access to the data base of Vodafone only in respect of 65,000 consolidated post paid subscribers.

The court directed both companies to communicate 65,000 consolidated post paid subscribers about the termination notice.

"Vodafone and Matrix will, within a week from today, address a joint communication to each of the 65,000 Consolidated Post Paid Subscribers apprising them of the letter dated 14th October 2011 and the fact that the agreement dated 10th July 2003 between them will stand terminated on the expiry of two months from 14th October 2011," it said.

Matrix Cellular Services provides telecommunication solutions for Indian travellers going abroad and it also offers international SIM cards, international 3G data cards, student mobile services, and wireless communication services.
