HC issues contempt notice to Vodafone on a plea of Matrix

The Delhi High Court has issued contempt notices against five officials of Vodafone Essar for allegedly violating its order asking the telecom major to restore services of Matrix Cellular, which offers telecom solutions to Indians visiting abroad, for next two months for providing help to post-paid subscribers.

"Issue notice to respondents (officials) returnable on November 23. The notice be taken dasti (by hand) as well," Justice Vipin Shanghi said.

The court sought responses from Director Vodafone Essar Sanjoy Mukerji, Rajiv Kohli, MD and CEO Marten Peters, Shaina Subramaniuam and Monika Pathak and put the matter for further hearing on November 23.

The notices were issued on a fresh petition of Matrix Cellular Services alleging violation of earlier court orders directing Vodafone to restore services on its helpline mobile number 9811188888.

Earlier, another bench of Justice S Muralidhar had disposed off a petition of Matrix by passing an interim order saying the termination of the agreement between Matrix and Vodafone would come into effect after two months and during the period, the telecom major would restore the helpline number.

"Vodafone will forthwith restore services to Mobile No 9811188888, which is in the name of Matrix, and make the same operational as it was on October 13, 2011, i.e, prior to the issuance of the letter on October 14, 2011," the court had said.

Matrix had approached the High Court alleging Vodafone had on October 14 unilaterally terminated the agreement, entered into between the two firms on July 10, 2003, by serving a notice which said "the agreement would stand terminated two months thereafter".
