RComm defends position on blocking websites

Under the law, the authority to block websites in India rests only with Department of Information and Technology

After blocking major file-hosting websites through broadband services provided by Reliance Communications, the company said that it acted in accordance with the law.

A Reliance Communications spokesperson told Times of India, "Under Section 79 of the IT Act, an ISP has to adhere to any copyright infringement notice and court orders. Given that Reliance Entertainment has obtained a specific order from Delhi high court to protect Don 2 from online piracy, we are in full compliance of law."

On Friday morning, users connected to the internet through broadband services provided by Reliance Communications discovered they were not allowed to access several file-hosting websites with a message "this site has been blocked".

Under the law, the authority to block websites in India rests only with Department of Information and Technology (DIT). The exceptions in case of a court order blocking a website have to also be routed through the DIT. Section 79 of the Informatoin Technology Act 2000, which was amended in 2008, deals with the liability of intermediaries like internet service providers but doesn't explicitly talks about blocking of websites.
