HC dismisses review petition on public meetings on roads

Kerala government had appealed against the ruling of a division bench of HC banning public meetings on roads and road-sides

Kerala High court today dismissed a Review petition by state government against the judgement of Division bench prohibiting conduct of meetings on public roads and road sides.

A division bench comprising Justice C N Ramachandran Nair and Justice P S Gopinathan, said it was strange that the government resorted to file this petition.

'When there is general acceptance of judgement by the people and when the government does not have any grievance, we do not know what prompted the government file the RP', the bench held.

It is strange that despite frequent accidents due to deplorable condition of roads, the state inssists on permiting meetings on roads and road sides exposing to risk the life of public, the bench observed.

The court said such blockades was wrongful restraint punishable under sect 314 of IPC.

Any permission for holding meetings on roads and road margins leading to obstruction of traffic amounts to comission of offence under IPC, the court held.
