The Delhi high court today sought a response from the city government on a PIL seeking direction to frame rules to provide free and compulsory education to children from weaker sections under the Right To Education (RTE) Act.

A division bench of Chief Justice Dipak Misra and Justice Sanjiv Khanna issued notice to the Directorate of Education on the PIL filed by NGO Social Jurists.

The NGO counsel Ashok Aggarwal said the government has failed to frame rules under the RTE Act, which came into force in 2009, and as a result poor children are deprived of the benefits under the Act.

The RTE Act mandated that no child shall be liable to pay any fee or expenses which may prevent him from completing the elementary education, the petition said.

"Providing free and compulsory education to children is the statutory obligation on the part of the govertnment...," the counsel said.

The government's failure to frame rules for the disadvantaged groups could be construed non implementation of the RTE act, he said.

In yet another PIL by the same NGO for direction to appoint special educators in various schools for the disabled children, the bench sought the government's response by August 24.

According to the NGO, despite repeated orders from the court, the government failed to act upon by appointing the special educators in the unaided private schools.
