Asserting that everybody should be treated equally before the law, the Bombay high court on Wednesday asked CBI to conduct a "good, honest and proper" investigation into the Adarsh Housing Society scam, and not get "bogged down by certain personalities".

The division bench of justices Ranjana Desai and R G Ketkar, after going through the progress report submitted by CBI, said, "You (CBI) carry on the investigation. But we only want you to do your job in accordance with law and treat everyone equally."

"We are not the investigating agency to direct you (CBI) to go after a particular person. But if someone is guilty then action should be taken against him. Do not get bogged down by certain personalities," justice Desai said.

This is the second report submitted by CBI, following directions from the high court last week to look into the allegations made against union ministers - Sushil Kumar Shinde and Vilasrao Deshmukh.

The court was hearing the petition filed by social activist Simpreet Singh seeking court's monitoring of the investigations. Petition says that CBI is hesitating to book Shinde and Deshmukh who are the "main accused" in the scam.

"We do not want an impression to be formed that the court is showing undue interest in one particular person. Let CBI investigate the case as they do in every crime. We would only supervise the investigations," justice Desai said.

CBI, in the latest report, has stated that it is probing the allegations.

Deshmukh, union minister for Rural Development and Shinde, union power minister, were chief ministers of Maharashtra when files related to Adarsh building were processed. The court has kept the matter for further hearing tomorrow, as petitioner's lawyer was not present today.
