The hearing on Gujarat IPS officer Rahul Sharma's petition, in the central administrative tribunal (CAT) challenging the chargesheet issued against him by the state government was on Thursday adjourned till October 5.

Sharma had approached the CAT early this month challenging Gujarat government's chargesheet against him served on August 13, alleging him of misconduct under Sec 3(1) of All India Service Rules 1969.

He is being accused of not submitting the original CDs containing mobile phone call records related to 2002 communal riots period to the respective investigating officers of riot cases or to his supervisory officers.

The original CDs are presently not traceable, and only copies of it were available.

Today, the Tribunal Bench of Mukesh Gupta and Ashok Kumar adjourned the matter till October 5 after Sharma's counsel Mukul Sinha sought time to produce a document showing that his client was infact summoned by Supreme Court Amicus curie in the post-Godhra riot cases Raju Ramchandran during his visit to state in June.

The bench had asked Sinha to produce the document showing that Ramchandran had summoned Sharma during last hearing in the matter.

Ramchandran had visited Gujarat after he was asked by the SC to comment on report of the special investigation team (SIT), probing some of the post-Godhra riot cases.

Sinha said that Sharma was on a training to Hyderabad and hence the summon by Ramchandran could be accessed only after Sharma came back, and sought time.According to Sharma, it was only after he deposed before Ramchandran, the govenment had chargesheeted him.

Sharma in his petition has alleged that the state government had acted with malice and distorted facts while chargesheeting him in connection with the CDs containing mobilephone call records during the 2002 riots.

He had further contended that there was a delay of nine years in action by the state government as it had issued show cause notice in the matter to Sharma for the first time only in February this year.

Sharma has made the chief minister Narendra Modi as one of the respondents in his petition, besides the chief secretary and additional chief secretary, home, Varesh Sinha.

Sharma, was serving as deputy commissioner of police (control), Ahmedabad during March 24, 2002 to July 3, 2002.

Sharma at that time had assisted the city crime branch in the investigations of riots cases and had prepared a CD of mobile phone call records of ministers, politicians, police officers and bureaucrats between February 29, 2002 to March 2, 2002 by obtaining mobile call records from Mobile service provider companies.

In his petition, Sharma while challenging chargesheet against him, has said that he had sent the CDs in question through a police messenger of the crime branch to then chief of crime branch P P Pandey.
