SC sets aside MRTPC order against British Airways

British Airways had been directed to pay Rs 51 lakh for delay in consignment delivery in 23-year old case

Providing some relief to British Airways, the Supreme Court on Jun 23 set aside a fair trade regulator’s order directing the aviation giant to pay a compensation of USD 0.11 million (around Rs 51 lakh) in a 13-year-old case of alleged delay in consignment.

A vacation bench comprising Justice R M Lodha and Justice A K Patnaik set aside the order passed by the regulator, Monopolies and Restrictive Trade Practices Commission (MRTPC), and directed the National Consumer Disputes Redressal Commission (NCDRC) to freshly decide the case.

The bench said that the regulator was wrong in declaring a delay in delivery of consignment as an “unfair trade practice” under the MRTP Act.
